June 28, 2023

ONE of the teens accused of murdering Nate Mimpiya said he would “f*** up” the youngster after developing a strong hatred for the 14 year old, the court hears.

“Nate” was killed after he was “lured” to a planned “joint” attack in Westpark in January of this year, jurors were told earlier today.

DA (Insert name) made this claim on the first day of trial into the 14 year old’s death at Orange County Supreme Court.

Two teenaged boys, who had a “dispute” with Nate both stand accused of murdering him at Bill Barber park on January 2, 2023.

The two, now 15 years old, deny the charges.

Prosecution in the trial said that a third teenager, a girl who cannot be named and isn’t standing trial, “continually” tried to lure Nate away from his Westpark address the day of the incident.

At around the same time, the girl was devising for the two boys to “ambush” and “trap” Nate at the fields using social media apps such as Instagram and Snapchat.

He was stabbed to death with a knife used by the younger defendant in the afternoon of the second of January 2023, jurors heard.

The girl and the older boy have admitted to the manslaughter of Nate Mimpiya.

Mr (insert name) said: “Nate was charged and stabbed by the defendants in a park next to his home.”

“The defendants planned to attack Nate Mimpiya with a girl. She then lured Nate to the location of the assault in Bill Barber.”

“The attack was devised in the days leading up to January 2. They were all provoked by disputes they had with Nate.”

“One of them were armed with a knife. They proceeded to carry out the joint attack and used the knife to stab Nate in the back and chest.”

“They had fled the scene, they then took detailed steps to get rid of incriminating evidence, and messages on their phones before being arrested by police.”

“Messages sent in the days leading up to January 2 inferred that a knife was to be put to use in the ambush.”

“By this alone, the prosecution supposed that the defendants knew about a knife being used, and intended that it should be used against Nate. That is exactly what happened.”

“The girl concurred to orchestrating the attack by coaxing Nate to the location from his home where he would be endangered to being ambushed by the defendants.”

“Nate was ambushed by the defendants. He was assaulted while the girl stood by watching. Her presence alone provides assistance.”

“He was stabbed once to the back and once to his front.”

“After he was stabbed, the defendants quickly fled the scene leaving Nate in the park. They were completely aware of the severity of the attack.

“They fixed to eliminating evidence that would connect them to the attack and the clothes they had on during the incident.”

“Neither one of them acted in self defense, they deliberately caused serious harm to Nate.”

“In no way are their ages a defense. Even though they were 14 and 15.”

During the first day of the trial, the jury was played recordings of voice memos and videos between the girl and the defendants.

The court was first shown a video of the defendants throwing up gang signs with their hands recorded on December 19, 2022.

Another video presented minutes later shows the exact same thing except they began talking in street slang which was hard to decipher.

Messages which displayed “hostility” towards Nate were firstly sent up to 2 weeks before he was killed.

These came after one of the defendants accused Nate of “snitching” on him, causing him to develop a “passionate hatred” towards Nate.

The girl and the defendants started to set up a meeting with Nate in the last days of December 2022. By December 31, “they were all taking part in sending hostile messages and started to talk about setting him up and jumping him.” The court hears.

A teenager, who hasn’t been charged but still participated in the planning of the set up, said to a defendant they felt like they were “a part of a criminal gang”.

(insert da name) alleges of the defendant: “He knew exactly what he was doing and knew exactly what the repercussions were most likely to be.”

“This was not some agreement to have a one on one fight. It was an attack on Nate Mimpiya when he was not expecting it. This was a planned ambush which was meant to put Nate in a defenseless and vulnerable position completely unaware of what was going to happen to him.”

Later on January 1, a defendant said Nate would get “f***** up” when he saw him and that he was going to be given “punches”.

In a separate voice recording sent from the defendant, he can be heard saying “I hate him with a passion. When I see him he’s getting f***** up… I’d probably just end up killing him or something.”

The girl affiliated with the attack says that she “wouldn’t care” if Nate died and “hopes he does” according to a message sent to one of the defendants.

In the early morning of January 2, the day of the incident, “hostile messages” between Nate Mimpiya and the older defendant were exchanged.

Later that day the girl was “continually” trying to lure Nate away from his home but they instead agreed on meeting at Bill Barber fields in Westpark.

At the same time, the girl was organizing for the two boys to “attack” Nate at the location.

Footage showed the duo meeting up at a gas station just minutes before the incident.

The younger defendant denies counts of obstruction of justice.

The older boy denies the same charge, but pleads guilty to another.

The trial continues.
